Historically, Microsoft has never managed to 'crush' competitors with
legal action, what they have done is to crush competition itself. They
have brought about delays, uncertainty, and unworkable rulings and other
such legal stupidity that have been enough to see microsoft take an upper
hand in a particular battle, but the companies survive, albeit without
much market share.
Open source would make the issues so much clearer, at least in it's
particular area, and as such I would expect to see less delays and
uncertainty arising from such lawsuits. Unworkable rulings are probably
here to stay :)
At any rate, with the source open, microsoft would have to start competing
largely on merit, and I think this would give other companies the chance
to play similar evil tricks on microsoft...
Not saying that's a good thing, but it's a fair thing.

If there has been an imbalance of justice, I'd like to see it redressed.
Granted, I'd rather see it redressed cheaply and swiftly, but the US
concept of 'justice' doesn't appear to have provisions for that.
