I have had similar issues in the parts with modems not negociating
protocol properly. Can I suggest if there is a possiblity of using
a different type of modem at either end to test you try that?
You could always to and find out what is actually failing and why
and try and fix that rather than playing a guessing game ;P

PS: I think I found that the problem I was having was something
to do with a timing issue and very short time outs on the modem.
