Is it? They only have one serious competitor, and the odds against said 
compewtitor NOT having reverse-engineered everything NVidia do are quite low. 
The only losers are those not competing.

In NVidia's defense, they have opened everything that's not directly 
addressing their hardware (e.g. framework for the Ethernet driver).
