Better than that, the contract was a three-way one between Santa Cruz, 
IBM and AT&T. AT&T (and so now Novell) have the power to modify or 
waive anything in it, and to act on behalf of the licencees (now TSG). 
And they did. Back in June, they not only directed TSG to waive any 
claim they had, but then when TSG didn't act, Novell acted on their 
behalf WRT the contract, by telling IBM (cc TSG) that any claims were 
waived.

TSG knew this and said nothing. The officially knew that they were dead 
men walking and acting illegally two months ago. Jail terms all around, 
boys.

On top of this, the original agreement (in Amendment X) was long ago 
made perpetual and could not be unilaterally cancelled even without 
Novell's oar in the water.

IBM and Novell, best buddies over a piece of "amateur" software. Who'd'a 
thunk it before last Easter? (-:
