Not illegal. In the past however, most merchant contracts would explicitly
state the business should not charge a fee to customers when paying with
credit cards.

Now the law states that businesses can pass on the costs (regardless of the
contract). Unfortunately I don't believe it has any ties with the actual
merchant fee. e.g. they may be charged 1.5% by the banks for customers paying
with VISA, but then charge a 5% fee!!
