I'm no lawyer (*whew*) but I believe the GPL refers to the obligation to GPL code which is a -derivative- of the GPL code. Now if it is proven in the IBM suit that the (if any) common code went from Linux _to_ SCO code, the GPL might require that it be GPL'd.. Wouldn't that be a stroke of justice...  8^)==

And a HUGE win for IBM..
