They don't, yes, and no it's not.  It's not a technical matter - the 
conditions say "don't do this", not "you cannot do this".  When you sign 
up with them, you have to abide by the terms of the agreement.  If you 
don't agree to their terms, you can either negotiate different terms 
(HA!) or you should sign up with someone else.
