It is if its within 12 months of purchase. This they cannot avoid.

How long have you had it? Warranties are a grey area. IANAL, but I believe the
law tends to lean towards the view than your item should work for a decent
amount of time, regardless of warranty. For example, if you bought a fridge
that had a 12 month warranty and it failed after 2 years, you could probably
still get a replacement by taking it to court since 2 years is not a decent
amount of time for a fridge.

Depending on how long youve had it, you could probably give fair trading (or
whatever theyre called) a call and see what your rights are, and whether it
would be worth pursuing. Especially with something that is obviously a design
flaw, Id think they should fix for free no matter how old it is (like the
click of death on external zip drives).
