Looks like it.. I disable hal from polling the drive by removing the scd0 device node and then power 
it down..

When I power it up and replace the node it's all good. If something tries to access the device while 
it's powered down libata goes into error recovery mode and everything appears to keep working. It 
loops in error recovery until the device is powered back up where it recovers perfectly.
