[plug] Optus Cable and FTP server

I have a friend who I'd like to send and receive files to who has 
Optus Cable. I have just a dialup connection. We're thinking of 
setting up a ftp server on his end so I can upload/download files at 
will but he is concerned that this is not legal.  I'm not sure either.

Anyone know whether it is legal and also is it permitted that dialup 
subscribers[like myself, with dingoblue] set up a ftp server ?
