Let's pretend that these infringements will be treated as a criminal 
offence and therefore be subject to being proved "beyond reasonable doubt".

How would you prove beyond reasonable doubt that such an infringement 
had occured? Especially seeing Microsoft are likely to have a bunch of 
IP lawyers whose sole purpose is to create that doubt in your case...

...they may even win an "On balance of probabilities".

I'd suggest we not fight their FUD with our FUD. Fight it with facts and 
even then be very careful when stating those facts publically.
